LACYER STUDIO ONLINE STORE TERMS AND CONDITIONS
These Terms and Conditions set out the rules for using the online store, creating an account, placing orders, using the newsletter, payment and delivery terms, the complaint procedure, the right of withdrawal, and information regarding the protection of personal data.
§ 1 General Provisions
- The Lacyerstudio.com Store operates under the principles set out in these Terms and Conditions.
- These Terms and Conditions cover the terms of concluding and terminating sales contracts for products offered by Lacyer Studio and specify the terms of complaints and the provision of services in connection with operating the Lacyer Studio store at the internet domain www.lacyerstudio.com.
- The Lacyerstudio.com Store declares that it offers new products, free from physical and legal defects, which have been lawfully placed on the Polish market.
- The information presented on the Store’s website does not constitute an offer within the meaning of the Civil Code. Information about goods together with the price presented on the Store’s pages constitutes an invitation for Customers to submit offers.
- In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply.
§ 2 DEFINITIONS
1. Consumer – a natural person making a purchase in the Store not related to their business or professional activity.
2. Store – the Lacyer Studio online store operated by the Seller at the address lacyerstudio.com.
3. Customer – any entity making purchases in the Store.
4. Account – the Customer’s account providing functionality for navigating the Store’s website, enabling, among other things, order tracking, viewing purchase history, and editing the Customer’s data.
5. Terms and Conditions – this document.
6. Newsletter – a service enabling the subscriber to receive from the Seller information containing informational, promotional, or advertising content, in particular commercial information, via email. This service is performed at a specified frequency, depending on the Seller’s needs and capabilities.
7. Subscriber – a natural person, legal person, or organizational unit without legal personality, which is granted legal capacity by statute, using the Newsletter service under these Terms and Conditions.
8. Contract – a distance sales contract concluded between the Customer and the Seller.
9. Entrepreneur – a natural person, legal person, or organizational unit without legal personality, which is granted legal capacity by statute, conducting business or professional activity on their own behalf.
10. Business days – days from Monday to Friday, excluding public holidays.
11. Seller – Entrepreneurs entered in the Central Registration and Information on Business (CEIDG):
a. Ignacy Koper, NIP 1231572547, REGON 540670461, an entrepreneur operating under the business name Ignacy Koper – partner in a civil law partnership
b. Laura Lewandowska, NIP 7622023894, REGON 540669179, an entrepreneur operating under the business name Laura Lewandowska – partner in a civil law partnership
conducting business within a civil law partnership under the name Lacyer Studio Laura Lewandowska i Ignacy Koper spółka cywilna, with its registered office at ul. Melanii 24, 05-500 Chyliczki, NIP 1231573127, REGON 540689265

13. Manufacturer – the entity producing a given product
13. Carrier – the carrier indicated in the Store through whom the Goods may be shipped to the ordering party
§ 2 CONTACT WITH THE SELLER
1. The Seller enables the Customer to make contact in the following ways:

§ 3 TECHNICAL REQUIREMENTS
1. To use the Store, a device with internet access and an active email account are required.
§ 4 CREATING AN ACCOUNT
1. The Customer may create an Account in the Store.
2. Registration is voluntary and free of charge. Logging in is carried out via a one-time code sent to the email address provided by the Customer. The Store does not store passwords. The email address assigned to the Account and login codes are confidential. The Customer is obliged to secure access to their email inbox.
3. Logging into the Account enables access to order history and editing contact details.
4. The Account may be deleted at the Customer’s request via email contact.
§ 5 NEWSLETTER
1. A Subscriber may sign up for the newsletter via the internet. This service is voluntary and requires the conclusion of an agreement. The newsletter agreement is concluded by providing an email address and consenting to receive commercial information.
2. Giving consent to receive commercial information is tantamount to a statement by the Subscriber that:
- the data provided by them is true,
- they have read the Privacy Policy.
3. In case of doubt, the Seller reserves the right to verify the data provided by the Subscriber in order to determine whether it complies with § 5(2) of these Terms and Conditions.
4. Commercial information will be sent to the email address provided by the person. The email address provided by the person can be changed at will. The change may be communicated to the Seller by email or in another way that allows this information to be conveyed.
5. Unsubscribing from the newsletter is voluntary and possible at any time via the unsubscribe link or by email contact.
6. In providing the newsletter service, the Seller acts as the controller of personal data, and the data provided by persons using the newsletter will be used only for the purposes of providing the newsletter service. With the Subscriber’s consent, their email address may be provided to third parties for the direct marketing of their goods or services.
7. As part of the services described in the Terms and Conditions, the Subscriber is prohibited from providing unlawful content. By accepting the Terms and Conditions, the Subscriber undertakes not to violate the above prohibition.
8. The Seller reserves the right to change the frequency of the newsletter services. The Seller also reserves the right to change the graphic form, content, and any other aspect necessary for the effective transmission of commercial information.

§ 6 ORDERS
1. Information about products in the Store constitutes an invitation for Customers to submit offers.
2. The Customer may place orders as a guest or with an Account in the online store.
3. To place an order, you must:
– add the product to the cart,
– complete the order form,
– choose a payment and delivery method,
– accept the Terms and Conditions,
– confirm the order.
4. The sales contract is concluded when the Customer receives confirmation of order acceptance.
5. Order processing begins after the payment has been credited to the Store’s bank account.
6. Customer orders are processed on business days, excluding public holidays.
7. The order fulfillment (preparation) time on the Seller’s side is from 1 to 5 business days.
§ 7 PAYMENTS
1. The Customer may make payment using electronic payment systems operated by external payment operators (e.g., PayNow, Przelewy24, Apple Pay, Google Pay, card payment).
2. The list of available payment methods is presented to the Customer each time during order placement.
3. The Seller reserves the right to change payment operators or add new payment methods without the need to update these Terms and Conditions.
4. Payment must be made within 7 days of placing the order.
§ 8 DELIVERY
1. Delivery is carried out within the territory of the Republic of Poland and to countries indicated on the Store’s website in the relevant section.
2. The delivery cost is provided during order placement. The cost depends on the delivery service cost set by the Carrier. The Customer bears the cost of delivery of the Goods, and it is indicated each time during order placement—before confirmation (in the so‑called checkout process). Information about the total delivery cost is also included in the order confirmation.
3. Delivery times are specified according to the information indicated by the relevant Carrier and presented on the website. As a rule, delivery time by the Carrier should be up to 3 business days, excluding international shipments and exceptional situations. In the indicated cases, delivery times may be extended.
4. Delivery methods include the forms of delivery at the given Carrier specified on the website at the time of concluding the sales contract.
5. The Customer is asked to check the condition of the shipment upon receipt. In the event of a loss or damage to the item, the Seller kindly requests that all necessary actions be taken to establish the Carrier’s liability, in particular drawing up a protocol specifying the condition of the shipment or the circumstances of the damage.
§ 9 RIGHT OF WITHDRAWAL
1. The Consumer has the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the shipment is received. To exercise the right of withdrawal, the Consumer must inform the Store thereof.
2. The period begins on the day the item is taken into possession.
3. To withdraw from the contract, an unambiguous statement must be sent. The Store must receive this statement in the form of a letter sent by traditional post or by email. The Customer may also use the withdrawal form available on the Store’s website.
4. Returns must be made without undue delay and no later than 14 days from the day on which the Consumer informed the Store of the withdrawal.

5. The refund will be made using the same means of payment as those originally used by the Customer in the transaction.
6. The Consumer bears the direct cost of returning the item.
7. The returned Goods should be in a condition not exceeding what is necessary to establish their nature, characteristics, and functioning. In particular:
a. the product should not bear signs of use beyond ordinary fitting, such as in a brick-and-mortar store,
b. it should have original tags, packaging, and a full set of accessories (if included),
c. it must not be soiled, damaged, or carry odors (e.g., perfume, cigarette smoke).
The Seller reserves the right to reduce the refund amount if it is found that the Goods were used in a manner exceeding the scope resulting from Article 34(4) of the Consumer Rights Act.
8. The return of Goods supplied in sealed packaging (e.g., personal underwear) after it has been opened is not possible (in accordance with Article 38(1)(5) of the Consumer Rights Act). This limitation applies to products which, after opening, cannot be returned for health or hygiene reasons.
9. In the event of withdrawal from the contract, the Seller refunds the cost of delivery of the order to the Customer, but not more than the equivalent of the cheapest delivery method offered at the time of placing the order.
10. If the Customer used a free delivery promotion applicable to an order of a specified value (e.g., above PLN 500) and then partially withdraws from the contract such that the value of the retained products no longer meets the conditions of the promotion, the Seller reserves the right to deduct the cost of the original delivery according to the standard price list in force on the order date.
11. The Customer may withdraw from the contract by submitting an unambiguous statement in this respect—in particular, they may use the return form available at:
§ 11 COMPLAINTS
- In the event of non-conformity of the goods with the contract, the Customer has the right to submit a complaint.
- With respect to Customers who are consumers, the Seller is liable for the non-conformity of the Goods with the contract in accordance with the Consumer Rights Act. In the case of Customers who are not consumers, the Seller is liable under the Civil Code.
3. A complaint can be submitted:

4. The Customer may submit a complaint about the Product due to its non-conformity with the contract. The notification should include:
a. the Customer’s contact details (email address or phone number),
b. a description of the defect or non-conformity found,
c. the initially preferred method of handling the complaint.
5. The choice of the method of handling the complaint will in each case be preceded by an individual consultation between the Seller and the Customer (by email or phone) in order to assess the nature of the non-conformity and determine the most appropriate and proportionate way to bring the goods into conformity with the contract.
6. The Store will consider the complaint within 14 days of receipt. The Store will repair or replace the Goods within a reasonable time. If repair and replacement are impossible or would involve excessive costs for the Store, the Store may refuse to bring the Goods into conformity with the contract. In assessing potential excessive costs, the Store considers all circumstances of the specific case.
7. The Seller reserves the right to refuse to fulfill the request indicated by the Customer if:
a. the chosen method of bringing the goods into conformity with the contract is impossible to perform, or
b. it would involve excessive costs compared to another available solution.
8. If the complaint is found to be justified, the Seller bears the costs related to the repair or replacement of the Goods, in particular shipping, labor, and materials—these costs may be settled differently only upon prior, explicit agreement concluded with the Customer.
9. The Seller is liable towards Consumers and natural persons concluding a contract directly related to their business activity, where it follows from the content of that contract that it does not have a professional character for these persons—under the principles set out in the Act of 30 May 2014 on consumer rights.
10. The Seller will repair or replace the Product without undue delay, no later than within 14 days from acknowledging the complaint, taking into account the nature of the goods and the purpose for which they were purchased. The costs of replacement or repair, in particular shipping, labor, and materials, are borne by the Seller. These costs may be settled differently only upon prior, explicit agreement concluded with the Customer.
§ 12 PERSONAL DATA
1. The controller of personal data is Lacyer Studio Laura Lewandowska i Ignacy Koper spółka cywilna, with its registered office at ul. Melanii 24, 05-500 Chyliczki, NIP 1231573127, REGON 540689265.
2. Data is processed in accordance with applicable law and the Privacy Policy.
3. The user remains anonymous until the moment of making the first purchase in the Store, creating an Account, or subscribing to the newsletter service.
4. The Customer’s personal data is processed for the purpose of concluding and performing orders placed via the Store, based on Article 6(1)(b) GDPR. Customers’ personal data may also be processed by the Seller for statistical and archiving purposes and for the purpose of pursuing claims related to the performance of orders placed via the Store, i.e., based on Article 6(1)(f) GDPR, and, after prior consent, for the purpose of newsletter subscription, i.e., based on Article 6(1)(a) GDPR.
5. The Seller will process Customers’ personal data for the entire duration of the Customer’s profile in the Store, for the period of order fulfillment, and also for a maximum of the full five years following the year in which the Customer placed the last order in the Store.
6. Details of data processing are contained in the Privacy Policy available in the Store.
§ 13 FINAL PROVISIONS
1. These Terms and Conditions are effective as of their publication on the Store’s website.
2. The Seller reserves the right to amend the Terms and Conditions. The Seller is entitled to introduce changes to the Terms and Conditions with effect for the future. Amendments to the Terms and Conditions enter into force upon their announcement on the Store’s website.
3. In matters not regulated herein, the relevant provisions of Polish law shall apply.
4. All disputes shall be resolved by the competent common court. A Customer who is a consumer has the possibility to use out-of-court complaint and redress procedures before the Permanent Consumer Arbitration Court at the Voivodeship Inspectorate of Trade Inspection in Warsaw.
